Seminole Nation issues 8% severance fee notice

A number of OIPA members recently received a letter from the Seminole Nation Business & Corporate Regulatory Commission (“BCR”) seeking to enforce an 8% severance fee subsequent to the issuance of Public Notice No. 2018-01.

The assessment would be in addition to any existing severance taxes. (View the letter below)
 
The letter states, in part, “[i]f you have an active oil and gas lease in our jurisdictional area a lessee permit is required for each lease….”
 
According to Section 105 of Title 33 of the Seminole Nation Code of Laws, “jurisdiction of the Nation” means “all ‘Indian country’ lands…as they existed in 1898 pursuant to the Treaty of March 21, 1866….”
